The United States Court of Appeals for the Third Circuit rejected Hunter Biden's efforts to dismiss federal gun charges against him. Biden, the son of President Joe Biden, was charged for purchasing a Colt Cobra 38SPL revolver in 2018 while he was actively using illegal drugs.

Prosecutors said that he lied on ATF Form 4473 by affirming he was not addicted to illegal drugs when he purchased the gun. In his memoir, Beautiful Things, Biden acknowledged he was addicted to illegal narcotics at the time he bought the revolver, which he owned for 11 days and never fired.

Biden thought that matter was resolved last year after reaching a plea deal with prosecutors on the gun charges and unrelated tax charges. However, during a July 2023 hearing, the judge rejected the plea deal.

The judge scheduled a pretrial hearing on May 24 and said the trial should begin on June 3. It is expected to last five to six days.

Biden is also scheduled to go on trial for the tax charges in June in Los Angeles.
